Terms and Conditions / Security policy
If you order a product on our website, you accept the following conditions. These conditions are subject to change at any time, it is your responsibility to check these terms before ordering products in case there are any changes.
Pricing: All orders are subject to acceptance and item availability. The price of each item is correct when you order but eFoodies reserve the right to change the price without notice.
Availability: Normally, all products shown on the website are available and will be delivered within 24 hours, (if ordered before 12pm Monday to Thursday, delivered Tuesday if ordered at other times) however if there is a problem with the availability of an item, eFoodies will endeavour to send you an e-mail or reach you by telephone to inform you. Please also note that all Fish products need to be ordered by 11am for next day delivery. Should a substitute be available we will add this to your order subject your approval, however if we cannot contact you we will send the original order without the out of stock item.
Refunded items: Items displayed on the website may occasionally be unavailable and/or may be out of stock. A full refund will be made if we are unable to deliver your product(s) and/or service(s). The refund will only be for the price of the product and/or service. Our liability for any transaction will not be greater than the price charged for the product(s) and/or service(s) pertaining to the transaction in question.
Your information: You guarantee that the information given on your order form is complete and accurate.
Order Acknowledgement: Once your order is completed, we will send you an email confirmation of your order. We will confirm the product you ordered, the quantity you ordered, the price, applicable VAT, applicable shipping & postage charges and delivery address. If we are unable to accept your order, we will contact you to inform you of this and provide you with the reason for our being unable to accept your order. We aim to do this in a timely manner.
Legal Jurisdiction: Any commercial dealings or contracts entered into with eFoodies and the Terms & Conditions of Trade contained herein, shall be governed by English Law. Any disputes which may arise are subject to English Law and shall be addressed and decided exclusively by the courts of England.
Payment: All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
Returns: If you want to return a product because you are not satisfied, please call our sales department at 0845 643 9121.
Images and Graphic Depictions: Images on our website are intended for guidance only and are not necessarily displayed to scale or exact colour definition. Graphic depictions may not, therefore, be identical to actual products and should be used for general guidance only.
Delivery: Delivery is designed to take place within one working day from the day of placing the order, except where an order is placed on a Friday, Bank Holiday, Saturday or Sunday. When an order is placed on a Friday or non-working day, delivery is designed to take place on the second working day following the placing of an order. Someone MUST be at the address of delivery to receive the parcel - delivery times are anytime between 9 - 5pm or anytime before 12pm. We do not accept any responsibility for the state of a parcel that is sent back to a courier depot due to a recipient not being at the shipment address.
Perishable Food Excluded from 'Cooling-Off' Period:
The perishable foods we sell on this website are excluded from your statutory right to withdraw purchases within the seven working day 'cooling-off' period. The cooling off period does not apply to perishable food items.
Frozen Foods: Any items ordered from eFoodies that are frozen or chilled, will be sent out on an ice or gel pack to the customer. It is the customers responsibility to unpack the items and place them back into a suitable freezer container or chest, in order to maintain the frozen temperature of the item. eFoodies does not accept responsibility for any items that have not been replaced back into the freezer upon immediate delivery.
PLEASE NOTE THAT EFOODIES DOES NOT ACCEPT RESPONSIBILITY FOR THIRD PARTY DELIVERY OF THE PRODUCTS THAT YOU ORDER. FROM TIME TO TIME PRODUCTS MAY NOT ARRIVE ON TIME AS REQUESTED. THIS IS NOT THE RESPONSIBILITY OF EFOODIES.
